As the expansion of the Internet and the digital formatting of all kinds of creative works move us further into the information age, intellectual property issues have become paramount. Computer programs costing thousands of research dollars are now copied in an instant. People who would recoil at the thought of stealing cars, computers, or VCRs regularly steal software or copy their favorite music from a friend's CD. Since the Web has no national boundaries, these issues are international concerns. The contributors-philosophers, (...) legal theorists, and business scholars, among others-address questions such as: Can abstract ideas be owned? How does the violation of intellectual property rights compare to the violation of physical property rights? Can computer software and other digital information be protected? And how should legal systems accommodate the ownership of intellectual property in an information age? Background Nonanonymized direct contact between organ recipients and donor families is a topic of international interest in the adult context. However, there is limited discussion about whether direct contact should be extended to pediatric settings due to clinician and researcher concerns of the potential harms to pediatric patients.Methods We interviewed pediatric organ recipients, their families, and donorfamilies in British Columbia, Canada, to determine their views on direct contact. Interviews were conducted in two stages, with those who were further removed from (...) the transplant process informing the approach to interviews with those who more recently went throughthe transplant process.Results Twenty-nine individuals participated in twenty in-depth interviews. The study included participants from three major organ systems: kidney, heart, and liver. Only five participants expressed that direct contact might cause harm or discomfort, while twenty-three indicated they saw significant potential for benefits. Nearly half focused on the harms to others rather than themselves, and nearly two-thirds focused on the benefits for others rather than themselves.Conclusion There appears to be a community desire for direct contact in pediatric organ transplant programs among those living in British Columbia, Canada. These results suggest a need to revisit the medical community’s assumptions around protection and paternalism in our practice as clinicians and researchers. (shrink)

A conception of an environmental ethic is set forth which involves postulating that nonconscious natural objects can have value in their own right, independently of human interests. Two kinds of objection are considered: those that deny the possibility of developing an ethic ofthe environment that accepts this postulate, and those.that deny the necessity of constructing such an ethic. Both types of objection are found wanting. The essay condudes with some tentative remarks regarding the notion of inherent value.

In the years since man achieved the capacity for self-reference, shame has come and gone; treatments for bodily complaints have alternated and crossed with treatments for spiritual ones; pleas to external gods have echoed pleas to internal demons. To understand the history of depression is to understand the invention of human being as we now know and are him. Our Prozac-popping, cognitively focused, semi-alienated postmodernity is only a stage in the ongoing understanding and control of mood and character. (Solomon 2001, 286) ALTHOUGH ANDREW SOLOMON clearly believes that "the shape and detail of depression have gone through a thousand cartwheels," Jennifer Radden gives us pause before assuming that depression is just another name for Dame Melancholy. Solomon's claim depends on a deeper metaphysical claim about the nature of depression and its causes. The current method of psychiatric nosology, descriptivism, does not necessarily support equating melancholia and depression. Furthermore, it appears that adopting descriptivism as the sole method of classifying mental disorders commits us to cultural relativist psychiatry. Below I reconsider whether we want to rule out causal classifications and suggest that embracing both descriptivism and causal classifications offer us greater possibilities in understanding human illness and culture.Although the occasion for Jennifer Radden's essay is to investigate whether or not melancholia and depression refer to the same thing, her essay detours into a consideration of extra-descriptivist models of psychiatric illness versus the descriptivism of current psychiatric nosology. This detour turns out to be warranted; her purely academic question yields to a timelier question concerning the proper methodology for classifying mental disorders. Whereas debates about psychiatric nosology are perennial, the recent success of the new generation of antidepressants [End Page 57] is reviving biological psychiatry and its search for the neurochemical origins of depression. Hence, embedded in Radden's question concerning whether or not melancholia is the same thing as clinical depression, is another important question concerning the causes of mental illness, particularly depression.Currently, with its descriptivist approach, the Diagnostic and Statistical Manual of Mental Disorders (DSM) does not classify mental illness, such as clinical depression, based on underlying causes. The cluster of symptoms and behavioral signs that lead a clinician to diagnose one as depressed that are contained in either the DSM or the International Classification of Diseases (ICD) may be too fuzzy or elusive to give any clear distinction between major depression, mild depression, and the blues. For example, one group of epidemiologists points out that [t]he DSM-III, DSM-III-R, and DSM-IV acknowledge that depression, like many mental disorders, has no currently obvious natural classes... The significance of colonialism and decolonization for the dawning of European integration and their subsequent bearing on notions of European identity still constitute a largely unexplored field within research. In seeking to problematize and amend this state of things, this article embarks on charting a set of historical developments which provide a case for arguing that theoretical and empirical studies on the nexus of European integration and European identity need to pay much closer attention to questions pertaining to colonialism and (...) decolonization. As such, the article seeks to offer a glimpse of what it takes to be a critical background against which scholarly debates on contemporary notions of European identity need to be considered. Such an approach, it is suggested, should be of particular value for research trying to come to terms with Brussels' current endeavour to foster a collective sense of European identity in the Union. In expanding on this exact point, the article also broaches the question concerning all those `non-European' territories in Africa, South America and elsewhere that are incorporated into the present-day European Union, but which, nevertheless, hardly ever surface as such in studies on the EU and its politics of European identity. We have reason to believe that phenomenal properties are nothing over and above certain physical properties. However, doubt is cast on this by the apparent epistemic gap that arises for attempts to account for phenomenal properties in physical terms. I argue that the epistemic gap should be divided into two more fundamental conceptual gaps. The first of these pertains to the distinctive subjectivity of phenomenal states, and the second pertains to the intrinsicality of phenomenal qualities. Stoljars ignorance hypothesis (IH) attempts (...) to undermine the epistemic gap by arguing that the apparent inexplicability of the phenomenal is merely a symptom of our limited conception of the non-experiential world. I establish some obstacles to IH, and argue that the correct analysis of the epistemic gap means these obstacles can only partially be overcome. I propose, nonetheless, that IH can still be put to good use as half of a hybrid account of phenomenal consciousness. The proposal combines a self-representationalist account of the subjectivity of phenomenal states with a Russellian version of IH that accommodates the qualitative character of those states. This neo-Russellian ignorance hypothesis (NRIH) credibly undermines the appearance of an epistemic gap between the physical and the phenomenal. (shrink)

This article adopts an issues management approach to corporate social responsibility implementation. Issues evaluation, which is an integral component of issues management, can be conducted by using the concept of three expectational gaps. However, the concept of expectational gaps suffers from an ambiguity that limits its application to issues evaluation. The legitimacy gap concept is used in this article to clarify the ambiguity surrounding expectational gaps. The study thus develops a four-gap framework for conducting a quantitative issues evaluation. This framework (...) is applied to six social and six environmental issues in the context of the forest products industry in the Northwest United States by means of a survey of 278 society and 94 industry respondents. Results empirically demonstrate the existence of expectational gaps and also provide insights into the nature of misalignment between societal and business perceptions along these social and environmental issues. Appropriate managerial responses are suggested to narrow or bridge different types of gaps. (shrink)

Despite his protests, there have been numerous efforts to enroll Davidson in the deflationist program. Michael Williams has recently continued this enterprise, arguing that a truth‐theoretic Davidsonian approach to meaning can be harnessed to a deflationary approach to truth. It is our contention that Williams’ attempt is unsuccessful.

This paper explores ethical issues raised by whole slide image-based computational pathology. After briefly giving examples drawn from some recent literature of advances in this field, we consider some ethical problems it might be thought to pose. These arise from the tension between artificial intelligence research—with its hunger for more and more data—and the default preference in data ethics and data protection law for the minimisation of personal data collection and processing; the fact that computational pathology lends itself to kinds (...) of data fusion that go against data ethics norms and some norms of biobanking; the fact that AI methods are esoteric and produce results that are sometimes unexplainable and the fact that computational pathology is particularly dependent on scanning technology manufacturers with interests of their own in profit-making from data collection. After dealing with some methodological and definitional questions aimed at justifying its focus on bringing out the practical consequences of adopting democracy as a human right, in Part 3 the paper outlines and criticises arguments commonly made against having such a human right. It distinguishes between those arguments that deal with: alleged conceptual inadequacies, such as that democracy does not satisfy defining criteria for human rights, such as universality, importance and intrinsic worth, political doubts relating to the practicality of ‘self-determination’ (...) and the acceptability of international intervention on the grounds of democratic deficits, and weaknesses and inconsistencies relating to the legal implementation of democracy, such as the problem of having democracy as a human right when a function of human rights is to limit democracy and, in international law, the reluctance to adopt measures against non-democratic regimes. The paper questions these arguments individually, and points out that, if sound, they would exclude several generally accepted human rights. This exposes a pattern of unjustified discrimination against the idea that democracy is or ought to be a human right. (shrink)

This article aims to consider how the ‘diagram’ or ‘little machine’ is integral to the dissociative, at once polyvocal and polymorphous writing that marks the work of Blanchot and that, in turn, informs the disjunctive – hence critical and productive – operation within the register of Deleuze's writings on cinema. I shall consider a number of Deleuze's ‘keywords’ or recurring formulas as diagrams, that is, as intermediate configurations at once visual and lexical, in order to show how, like rebuses or (...) ideograms, they form collisions and ruptures of voice and graphic form, in order to bring forward the ‘outside’ of thought – what cannot be put into language yet is conveyed in language. This paper argues for the importance of a passive form of embodiment for educational purposes to capture tacit environmental influences. G. Buck’s account of learning as experience is put in discussion with psychological approaches to reveal the limitation of what psychology can achieve, especially when it comes to situated experiences within educational environments. As a solution to overcome this problem a concept of passive embodiment is developed that allows for a body that is receptive to multisensory environmental influences. Böhme’s concept (...) of atmospheres in relation to Schmitz’ New Phenomenology provide a theoretical framework to understand how these situated experiences are evoked by certain situations. This allows for a new understanding of passive, embodied experiences within educational environments by incorporating the tacit influences of the setting. (shrink)

The requirement that animals be used in research and testing in order to protect humans was formalized in the Nuremberg Code and subsequent national and international laws, codes, and declarations. We review the history of these requirements and contrast what was known via science about animal models then with what is known now. We further analyze the predictive value of animal models when used as test subjects for human response to drugs and disease. We explore the use of animals for (...) models in toxicity testing as an example of the problem with using animal models. We conclude that the requirements for animal testing found in the Nuremberg Code were based on scientifically outdated principles, compromised by people with a vested interest in animal experimentation, serve no useful function, increase the cost of drug development, and prevent otherwise safe and efficacious drugs and therapies from being implemented. In many social contexts, social influence seems to be inescapable: the behavior of others influences us to modify ours, and vice-versa. However, social psychology is full of examples of phenomena where individuals experience a discrepancy between their public behavior and their private opinion. This raises two central questions. First, how does an individual reason about the behavior of others and their private opinions in situations of social influence? And second, what are the laws of the resulting information dynamics? In this (...) paper, we address these questions by introducing a formal framework for representing reasoning about an individual’s private opinions and public behavior under the dynamics of social influence in social networks. Moreover, we dig deeper into the involved information dynamics by modeling how individuals can learn about each other based on this reasoning. This compels us to introduce a new formal notion of reflective social influence. Finally, we initialize the work on proof theory and automated reasoning for our framework by introducing a sound and complete tableaux system for a fragment of our logic. Furthermore, this constitutes the first tableau system for the “Facebook logic” of J. Seligman, F. Liu, and P. Girard. (shrink)

This article explores the experiences of employed and unemployed Ontario Basic Income recipients in the Hamilton and Brantford pilot site. Integrating data from surveys and interviews, the self-reported outcomes of both groups are summarized. These outcomes pertain to employment, physical health, mental health, use of health services, food security, housing stability, financial well-being and social activities. The article highlights the difference in the degree of improvements between recipients who were working before and during the pilot versus those who were not (...) employed at both times. Its broad conclusion is that both groups reported significant benefits, but it was recipients who were continuously employed that reported the greatest improvements. This suggests that basic income could be an important policy tool to improve the lives of low-income and precarious workers in Ontario and perhaps elsewhere. (shrink)

As a technology of commemoration, epinician song was a late archaic innovation. To gain acceptance for this innovative genre, Pindar works to anchor it to Greek epic and encomiastic poetry, that is, to demonstrate its continuity with these genres. But Pindar also regularly vaunts his poetry on the grounds that it is novel and inventive, potentially undermining his efforts at anchoring. This paper studies Olympian 13 as an example of a text in which Pindar’s habits of anchoring his poetry and (...) advertising its inventiveness are effectively reconciled. I argue that the ode’s central Bellerophon myth, a pointed rewriting of Homer’s account of Bellerophon (Il. 6.119-211), and the ode’s hybrid meter are showpieces of poetic innovation that demonstrate the worth and originality of Pindaric epinician to the ode’s Corinthian audience, while at the same time anchoring this genre to Homeric epic and dithyrambic song. More than once in his writings, Hobbes pronounced on the scope and organization of science. He had provocative views about the subjects that could be termed “scientific” about the scientific subjects that were basic, and about the relative benefits of the various sciences. Some of these views reflect his allegiance to the new mechanical philosophy and his opposition to Aristotelianism; others show the influence of Bacon, who was a virtuoso deviser of blueprints for science. Still others belong to a program (...) of self-advertisement: Hobbes wished to be seen as an important scientist himself - an important worker in the field of optics and no less than the inventor of the science of politics. After expounding Hobbes's views about the organization of science and considering some of the problems they raise, I shall suggest that they throw light on old questions about what has been called “Hobbes's system”. In Religion Within the Bounds of Reason Alone Kant claims that human beings are radically evil and that this evil is to be regarded as both freely chosen and universal. Scholars have long struggled to makes sense of this paradoxical notion. In this paper I propose that the regulative concept of the supersensible as presented in the third Critique can be legitimately extended to cover the mysterious “subjective ground” of radical evil. More specifically, I argue that the symmetry between radical (...) evil and purposive nature warrants the notion of a common supersensible principle underlying both phenomena that is neither nature nor freedom but that motivates their mutual incursions. I call this doctrine of reflective judgment “supersensible monism.”. (shrink)

Since anecdotal evidence for a clash of culture between philosophy and business would appear to exist, it is hardly surprising that some business academics should be inclined to question the value of philosophical business ethics in general andmoral theory in particular. John Kaler's approach to questioning philosophical business ethics is surprising partly because it does not rely on considerations of this kind (Kaler 1999). He claims that ethical theories are open to a kind of internal criticism, and that this criticism (...) justifies people in dispensing with moral theories. The argument is strikingly abstract and general for a criticism of moral philosophy, surprisingly `philosophical' or `theoretical', and if it is supposed to contribute to business ethics partly by drawing on negative arguments from the ethical theory it attacks, it may be self-refuting. The relationship between philosophy and theatre is a central theme in the writings of Plato and Aristotle and of dramatists from Aristophanes to Stoppard. Where Plato argued that playwrights and actors should be banished from the ideal city for their suspect imitations of reality, Aristotle argued that theatre, particularly tragedy, was vital for stimulating our emotions and helping us to understanding ourselves. Affirmative action refers to positive steps taken to hire persons from groups previously and presently discriminated against. Considerable evidence indicates that this discrimination is intractable and cannot be eliminated by the enforcement of laws. Numerical goals and quotas are justified if and only if they are necessary to overcome the discriminatory effects that could not otherwise be eliminated with reasonable efficiency. Many past as well as present policies are justified in this way.

Tom Eyers contrasts the different “movements” of the novel and the lyric poem: while moments of stasis in the novel are swept up in its narrative trajectory, atemporal moments in poetry can be juxtaposed against other kinds of temporality — for Eyers’s purposes, most importantly the temporalities of politics and history. The Theory of the Novelbecomes a theory of the lyric, undoing the persistent belief that history can only be made to appear in narrative.

Each title in this series is thematically assembled and designed by the artist, the covers featuring a linked painting specially created for each title from Tom Phillips's signature work, A Humument.With an illuminating foreword by Eric (...) Musgrave, 'Menswear' presents postcards of men in all manner of outfits, whether formal, practical or casual, dating from around 1900 up to c. 1949. Most of the subjects are posing for portraits, displaying both their individual style and an interpretation of the fashions of the time. By comparison with the prevention of terrorism, the prevention of acts of organized crime might be thought easier to conceptualize precisely and less controversial to legislate against and police. This impression is correct up to a point, because it is possible to arrive at some general characteristics of organized crime, and because legislation against it is not obviously bedeviled by the risk of violating civil or political rights, as in the case of terrorism. But there is a significant residue of (...) legal, moral and political difficulty: legislation against organized crime is hard to make effective; the harm of organized crime is not uniform, and so some preventive legislation seems too sweeping and potentially unjust. More fundamentally, the scale and rewards of organized crime are often dependent on mass public participation in markets for proscribed goods, which may point to a hidden public consensus in favour of some of what is criminalized. For all of these reasons, I argue that existing preventive policing and legislation against organized crime may be harder to justify than their counterparts in counter-terrorism, at least in the UK.
